Wi-Fi Service Terms and Conditions

Acceptance of Terms

By accessing and using the Wi-Fi service, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to the terms, please do not use the Wi-Fi service.

Data Processing and Privacy

In order to deliver the Wi-Fi service, TransPennine Express and our service provider Icomera must process certain data including your device's MAC address, train GPS position, IP address, timestamp, and session ID. This data is retained for a maximum of 12 months and is used solely for maintaining service quality and addressing support issues. Your data is processed within EU boundaries and in compliance with relevant regulations.

Service Provision

The Wi-Fi service is provided "as is" and "as available" without warranties of any kind, either express or implied. Icomera and TransPennine Express do not guarantee the service will be free of faults and cannot be held responsible for any interruptions or degradation of service.

Limitation of Liability

Icomera and TransPennine Express shall not be liable for any indirect or consequential losses, except in cases of death or personal injury due to negligence. This includes, without limitation, losses related to business, profits, or data.

Use of the Wi-Fi Service

You agree not to:

1. Use the service unlawfully or for any harmful, obscene, or harassing purpose.
2. Disrupt or impair the functionality of the service.
3. Transmit viruses or illegal content.
4. Infringe on the rights of others, including intellectual property rights.
5. Engage in unauthorised advertising.
6. Independently pursue any claim against another user without involving Icomera or TransPennine Express.

You agree to indemnify Icomera and TransPennine Express against all liabilities arising from your use of the Wi-Fi service.

Intellectual Property

All intellectual property rights related to the Wi-Fi service are owned by Icomera and TransPennine Express or their licensors.

Service Suspension and Termination

Icomera and TransPennine Express reserve the right to terminate or suspend the service immediately if you breach these terms and conditions.

User Data

The personal information collected through our Wi-Fi service, such as your name, email address, and Wi-Fi usage data, may be added to our Customer Relationship Management (CRM) system to improve your customer experience. This data will be used to provide you with support, service updates, and relevant information about our services.

Security

The security and privacy of the Wi-Fi service cannot be guaranteed, and you use the service at your own risk.

Changes to Terms

These terms may be amended over time. Continued use of the service after changes indicates acceptance of the new terms. Regularly review these terms for updates.

Severability

If any part of these terms is deemed unenforceable, the remaining provisions will continue to be valid and enforceable.

No Waiver

Failure by Icomera and TransPennine Express to enforce any provision of these terms does not constitute a waiver of rights.

Governing Law

The Terms and Conditions and any non-contractual obligations arising out of your use of the Wi-Fi service shall be governed by English law and LNER and you both agree to submit to the non-exclusive jurisdiction of the English Courts.

Please ensure the safety and security of your wireless device. Icomera and TransPennine Express are not liable for loss or damage to your device.
